The editorial cites with approval the conduct of the NC State Bar disciplinary committee with respect to its investigation into the alleged misconduct of a DA and one of his assistants in making deals with a star witness in a murder case that sent a man to death row. He has since been awarded a new trial.
So much for no precedent existing to pursue rogue DAs -- read all about it.

'OTHER' STRIPPER IN DUKE LACROSSE RAPE CASE REFUTES KEY PART OF ACCUSER'S STORY

In an interview set to run Sunday night, 60 MINUTES' Ed Bradley talks with the other exotic dancer caught up in the alleged Duke Lacrosse tape:
"In the police statement, [accuser] describes the rape in this way: 'Three guys grabbed Nikki,' 'That's you,' says Bradley, "'Brett, Adam and Matt grabbed me. They separated us at the master bedroom door while we tried to hold on to each other. Bret, Adam and Matt took me into the bathroom.' Were you holding on to each other? Were you pulled apart?"
"Nope," replies Roberts, who says she was hearing this account for the first time.

State Bar Files Ethics Complaint Against Mike Nifong

Raleigh — The North Carolina State Bar has filed an ethics complaint against Duke lacrosse prosecutor Mike Nifong, The Associated Press reports.
The complaint accuses him of breaking four rules of professional conduct when speaking to the reporters about the high-profile case.
Among the rules the bar complaint says Nifong violation is a prohibition on making, "comments that have a substantial likelihood of heightening public condemnation of the accuser."

Lacrosse case isn't racial tug of war
In response to "Blacks aren't judging Nifong" (Dec. 24):
I read with disbelief the statement by Michael Page, Durham County commissioner, after the release of evidence tending to exonerate the Duke students: "It's not going in our favor at this point."
Who is "our"? Did a rape have to occur for "it" to be going in "our" favor?
DNA doesn't lie. The truth is what we all should want.

ON OREILLY FOXNEWS JUAN WILLIAMS JAN 4, 2007 (an obvious supporter of the Accuser) made so many false accusations and misstatments vs the duke 3 that someone should really address these! it was insane that oreilly basiclaly took him for his word and didnt correct the lies!
Governor Easley spoke at NYU Law School today. In response to a student's question, the governor criticized the conduct of Mike Nifong in the Duke case and said it was a bad appointment and that he appointed Nifong in part as a replacement because he said he would not run again.
He said he did not know what the evidence would demonstrate in the case but as a former prosecutor he could say that Nifong's public comments about the accused were wrong.
He did mention the racist remarks made that night by some lacrosse players. I am not sure how that relates to the accused as none of them were accused of making these remarks but I believe he wanted to criticize Nifong but not go as far as to say that this was a miscarriage of justice. This could be for political reasons.
This is interesting as it is the first time that I am aware of, the governor openly criticizing Nifong's conduct. Hopefully, the comments will come out publicly in their entirety in a little bit.

I was very happy to see the walk on durham but a bit surprised by the turn out! 100 people! where were all the duke students, duke athletes? I truly believe that all duke students that did nto march ought to be ashmaed of themselves ...remember "there by the grace of god go i?"

Regarding the March 16th report that accuser is not cooperating with special prosecutirs It is amzing to me that here are still people and victims rights groups willing to defend her -- Mind Boggling!
Don't they know that she hurts the case for all women that are actually raped ...
It really opens one up to fact that many americans may be in jail because of PROSECUTORS such as nfong and women such as Gail Magnum
Professor Anderson makes one small slip several times in his fine new column. The Latin for 'sky' can be spelled a couple of ways, but "colelum" is not one of them. Read 'coelum.'

The Chronicle, March 27, 2007" there must be a way to reign in corrupt prosecutors. Be that by term limits (too much power is vested in prosecutors who stay in jobs for 6+ years) taking away shield where they can not be sued for reckless prosecution such as this duke case and other recent prosecutions.

Terry Moran and the Duke Three [John Podhoretz]
Terry Moran of ABC News has written a blog item entitled "Don't Feel Too Sorry for the Dukies." As a compendium of fashionable attitudes toward the Duke case, it is incomparable. It's instructive to go through it to examine those attitudes and why they are so noxious.
He says that "as we rightly cover the vindication of these young men and focus on the genuine ordeal they have endured, let us also remember a few other things:
"They were part of a team that collected $800 to purchase the time of two strippers.
"Their team specifically requested at least one white stripper.
"During the incident, racial epithets were hurled at the strippers.
"Colin [one of the three] Finnerty was charged with assault in Washington, DC, in 2005."
There were 46 members of the Duke lacrosse team. As far as I am aware, there is no evidence that David Evans, Reade Seligmann or Colin Finnerty collected the money for the strippers. Or that the three men had anything to do with the request for a white stripper, which I guess we are supposed to consider a racist act. Or that the three men were involved in hurling racial epithets at the strippers — which is, by the way, a fact totally in dispute, as the only witnesses for it are the liar Crystal Mangum herself and her fellow stripper, who has recanted much of what she originally said.
I agree that Colin Finnerty's arrest on charges of having been involved in beating up a man and hurling anti-gay slurs at him suggests that he may not be a very good person. Then Moran should trash him. What does Finnerty's arrest have to do with David Evans or Reade Seligmann?
Moran's main point is that we shouldn't feel too sorry for the three because they had the financial resources to fight back against an unjust prosecution. They are, Moran writes, "well-heeled, well-connected, well-publicized young men whose conduct, while not illegal, was not entirely admirable, either."
First, given the fact that we have no reason to believe Seligmann and Evans had anything to do with the slimy aspects of the evening in question, Moran has no right to describe their conduct as "not entirely admirable." To put it plainly: How the hell does he know?
Second, that they are well-heeled and well-connected is of no moment when we are talking about what happened to them, which was a kind of reverse-racist hate crime. We all know why Durham D.A. pursued their prosecution based on no credible evidence. He did so because they were white and affluent, and he either believed he was doing something brave or that he needed their scalps to guarantee his reelection.
The amount of money their parents may or may not have had does not mitigate the Kafka nightmare to which they were consigned. Indeed, America should be grateful their families had the resources to pursue their exoneration, as the process revealed that a the criminal-justice system in a city of 275,000 people was being run by a conscienceless sociopath. His certain prosecution and probable conviction on ethics and perjury charges will remove Mike Nifong from office and spare untold numbers of others who might be subject to his prosecutorial whim.
Including poor people. Including African-Americans.
Finally, Moran offers one of those cutesy, let's-roll-the-news-events-of-the-moment-into-a-neat-package sentence when he says dismissively that the three men are "are very differently situated in life from, say, the young women of the Rutgers University women's basketball team."
Yes, they are. They spent a year in torment, as did their families. They and their families incurred huge legal fees (and it says something about Terry Moran, awash in a multi-million-dollar network contract, that he might think "well-heeled people" can afford $1 million plus in legal fees without suffering hundreds of sleepless nights over them and the possibility of having to, say, go into hock for the rest of their lives).
The Rutgers women's basketball team was insulted by a shock jock, and in about 12 minutes became America's darlings. I'd say the Duke three were "differently situated." With the exception of Don Imus, America has greeted the Rutgers team as heroes. Most of elite America was certain for months that these three men were guilty of rape.
Maybe Terry Moran should get someone to plagiarize his blog items, the way Katie Couric did. They'd be a whole lot better.

"I can only hope that the travesty at Duke will cause corrupt or even overzealous prosecutors from proceeding in the face of an absence of evidence. During the pendency of the farce i repeatedly asked Dean Bartlett of Duke Law to make a public statement about Nifong's conduct of the case-until Proffesor Coleman came public not a single law professor at Duke took up for the rule of law-a truly disgraceful performance. As someone who has been hesitant to find cops and prosecutors less than honest, this affair opened my eyes to a different reality--cops will lie on occasion and prosecutors will keep evidence from defendants. When this happens we are not better than the Soviet Union or Hussein's 'justice system'. I am reminded of the illegetimate prosecutor of the former Secretary of labor, Ray Donovan, when he spent millions of dollars defending himself from bogus charges from a NYC prosecutor. Donovan was ultimately acquitted after a tortuous several years----"where do i now recover my reputation" Keep up the good work with this blog.
