Durhamite here wishing to address the poster from the previous thread...don't think you have to worry too much about voir dire. It only takes one person to keep justice on track. Yes, there are racists like that young misguided fellow at NCCU who wants to convict even if they are innocent just to even the score. In my dealings with folks (and believe me, I talk to EVERYONE I know b/c I am so P.O.d) everyone is at least against Nifong if not for Reade, David, and Collin.

Additionally, I do not have connections to media types but wonder if anyone besides Dan Abrams wants to present the truth. Unlike what Fox Mulder would say, the truth is just not out there, or maybe it's just not out there enough. For instance, do you know how many people STILL don't know that Ryan's admittedly stupid email was in reference to American Psycho??

Getting the truth out is hard if your position conflicts with what will get ratings or sell papers. For example, on the day of the multi-faith prayer service at Duke Chapel I happened to be running back to the CC trail from the Gardens so I stopped to see what was what. The WRAL reporter saw me (a mommy with cute baby in a jogger) and asked if I'd answer a few questions for her once she established I lived in Durham. This was pre-indictment, so her main question was "Do you think there'd be indictments already if it was a black on white crime?" I said that I didn't think that was the case and that saying this was about race was (to use Kim's words) a crock. I said people use race to arouse emotions so that facts would be obscured. I said I blamed Nifong completely for the whole mess and I actually had tears in my eyes when I said it had done so much damage to my community and to the lives of all the Duke students who were innocent of anything. I guess that wasn't what she wanted, because she didn't interview me on camera.

Above poster: Thank you Durhamite mom. This is what I was hoping to hear. You give me new hope. I am so glad you posted. Please keep in touch with us. Everything you wrote is correct. My kid in Duke was interview by one of the TV stations. As soon as he said something positive indicating that he supports the players, they stopped the interview and moved on to another student. The one-sided media has been a big part of this huge mess. They don’t event stop and think that they may be destroying the lives of innocent people and their families. It is incredible how many people got so hurt as a result of this scandal. For some, actually for many, this hurt will last a life time. Thanks again for your excellent post.

Unfortunatley, Please don't expect any changes will be made at Duke-the chairman of the board of trustees is singing out of the Brodhead hymnal...."strong and consistent leadership"???

Steel is bloviating about issues of race and gender, yet ignores the absence of the fair and consistent application of law by Nifong the past two months. Doesn't address the vicious trashing the players have taking in the press, all of which is the result of a psychotic, prevaricating, manipulative, criminally disposed stripper/escort and a corrupt prosecutor. Why is everyone at Duke afraid to state the obvious-she is a lying, scheming whore----

Other than a couple priests from Delbarton and Chaminade standing up for Seligman and Finnerty where is the outrage.
Steel wants to get the 'dial set right on individual responsibility of students'-please, how about holding public figures like Nifong to minimal standards of ethical responsibility. Or god forbid your faculty-80 of whom condemned the lax players as racists-or the dean of students who wrote an article in the Chronicle of Higher Education doing everything but saying the key should be thrown away on these guys.

A ceo or university president salivates over the following: "the president runs the university"...excuse me,the Board is in charge Mr.. Steel, not an employee, which is what Brodhead is. "Issues of class and issues of university community". There's the self loathing liberal horse shit again. Talk about a group of people who don't have the proverbial backs of the students. Another example of the slide of our 'elite' institutions-even board members don't have the guts to do and say the right thing...probably because they don't know what that is after a lifetime of self absorption and the making of offerings at the altar of political correctness. I suppose if you write a big enough check to earn a spot on the board (either because you inherited it or you lined your own pockets in a public company) or represent some 'dispossessed' community, you too can spout the pc nonsense of Mr.. Steel and Mr.. Brodhead-all the while condemning your 'traditional' student body and the people(I.e parents and benefactors) who have worked so hard to pay tuition. I can only hope that the parents of Duke students show their disdain by withdrawing from the annual fund/parents fund this year.

I happen to know that Friends of Duke Lacrosse is looking for a spokes person, someone to speak on behalf of this community and express these sentiments that we all share. If you do not have reasons for remaining anonymous (i.e. employed by Duke, student at Duke, parent of a Duke student etc.) would you consider taking this on? We really need a good spokes person to counter all the garbage that has been said so far without any basis and without any challenge. If interested, send an email to Friends of Duke Lacrosse. Unfortunately, college campuses have long since lost the notion of "learning communities" and bastions of open-mindedness.

The reality (since the early 90's at least) is that if you are not with the politically correct or the popular agenda, you are an outcast and risk being disconnected from the "community."

At least a few brave Dookies are stepping forward to support the members of the team being crucified for something that hasn't been proven yet. This is indeed a witch hunt right now.

This is how the Durham District Attorney and the Durham "community"

What is especially interesting is the fact the this was a real kidnapping and the kidnapping, a very serious felony was dismissed.

DURHAM -- As the Duke University lacrosse rape case continues to grab national attention, another sex-assault accusation with a Duke connection has quietly faded away.

It involved taxi driver Hasan Ateya Kafi, 45, who was accused last year of feloniously kidnapping a Duke student and committing misdemeanor sexual battery against her.

Court records show that Kafi was allowed to plead guilty this month to only the misdemeanor, receiving a 60-day suspended jail sentence and 18 months of probation.

The kidnapping charge was not prosecuted, and an apparently unrelated allegation that Kafi took indecent liberties with a child was dismissed, the records indicate.

Assistant District Attorney Tracey Cline, who handled the case, did not respond to a request for comment Tuesday.

The kidnapping and battery charges arose on the night of April 1, 2005, after a female Duke student called Durham's Best Cab Co. for a ride home, police said at the time.

A cab driven by Kafi picked up the woman near Duke's East Campus, according to Durham police.

But instead of taking the student home, Kafi drove around with her for about an hour along areas around Hillsborough Road and Broad Street, reports indicate.

Arrest warrants state that, during the ride, Kafi groped the woman and touched various parts of her body, including her buttocks, while keeping her in the car against her will.

She reportedly was unable to get away or call for help on her cell phone.

Kafi was the subject of a January 2005 Duke Chronicle story that portrayed him as "a bona fide Duke pimp" due to his popularity with female students.

Defense lawyer James D. "Butch" Williams said the case was resolved under a seemingly paradoxical provision of the law that allows someone to plead guilty without actually admitting his guilt.

"Looking at the totality of the circumstances, it was in Mr. Kafi's best interests to enter this plea and move on with his life," the attorney said Tuesday. "No one did me no favors. This was a fair resolution of the case, given all the facts and circumstances."

(And what about the best interests of the victim and the best interests of other women and children he will assault?)

I watched a show on vhi last evening about strippers in n. carolina being recruited to be in gangsta rap videos- it was absolutley degrading and disgusting what these women will do for money - all of them had children and they justified their actions by saying i will do anythign for the benjamins -one women humped singer in a pool while he stated i ve got hos in the pool ! i do agree to a certain extent that young men and women who have gone to private schools nd then head off to duke have no idea what these sorts of lowlife characters will do for money- i blame nfong - he held a carrot out to this girl -after watching the "hos in the pool" i can only imagine that each of them would have indeed do anything for the benjamins and claimed rape if the situation was lucrative enough.

My summary: Defense files motion asking for more evidence from Nifong. The police asked the accuser for a description of the attackers shortly after she made the rape claim. The defense says her response was not included in the files that Nifong turned over. They filed a motion to get that information, saying Nifong did NOT turn over everything he had, as he claimed in court.

Looks like Nifong(TPOS) and Crew are at it again, The report or reports that B.W.Himan and other officers took seem to have disappeared. The reports and notes taken the night of the alleged rape by Durham police officers contained the accusers descriptions of the persons that allegedly raped her at the Duke Lacrosse party. The question now is, Did the Police hide these reports and notes or did the DA Nifong(TPOS)make them disappear? If anyone is wondering,

I think this is just the beginning of a lot of questions that the Durham PD and Nifong (TPOS-I like that) are going to have to answer. I hope that the families of all the players are planning lawsuits against Durham PD, Nifong(TPOS), and Duke. I am a Durham resident that is DISGUSTED by the behavior of all of them.
I really just would like to know when Nifong(TPOS) and his cronies are going to stop this charade and drop all the charges. My husband and I decided to move out of Durham if the case goes to trial. We do not want to live in a city where being white is a crime.

Hello everyone.

I would just like to say hi and that I completely support these young men in this absolute travesty of justice.

I have been very impressed by this site and the support from it.

During the past couple of weeks I have been trying to find ways to make myself feel better about the railroading happening to these young men, and the only real stress relief I found was to create some nasty photoshopped pictures of Mike Nifong, who it goes without saying, I find repulsive.

I would not want to offend anyone's sensibilities, or make fun of a serious situation, but sometimes laughter is the only thing we have.

Do you think it it would be alright if I posted links to the images I created? That way anyone who felt like having a giggle at Nifong's expense could do so, and maybe share them with others who were in need of a laugh to help them through the tension of the fiasco this lunatic has created.

I would be happy to post them. Please let me know if this is appropriate as I could post them in the links section I suppsoe.

Also, many of my pro-defense friends and I have taken to calling the D.A. "Gino M. Finke" which is an anagram for Mike Nifong.

Is there no end to the mishaps that took place in this case? It appears that the DA and the Durham police didn’t do a single thing right. Every passing day, there is a new revelation that something else went wrong. This case is clearly a smoke screen. There was no rape; no crime was committed. This was all concocted by a vicious DA to get elected to office. If Nifong had not heard about these accusations and decide to get his dirty fingers in it, it would have gone away long time ago. Just like other false accusations. Nifong is the one who kept this alive.

Then, other Durham administrator decided to jump on the band wagon too. This is how it all came about. I cannot wait until someone in NC decides to stop this mess. There will be huge backlash on all those who have the power to stop this, and do not act. Wait and see; it will happen. I trust that American people will see perfectly well what is going on here. Nobody is fooling anyone. I bet even Jesse Jackson and Al Sharpton know that there was no rape. When will Patrick Bakes see it? When will the NC Attorney General see it? Most importantly, when will Brodhead see it?

I am the parent of a Duke student who has great affection for the institution. I also am convinced the boys are innocent.

In reading some of the posts on this blog, however, there are a few with an undercurrent of racial prejudice.

Duke's student body when it was founded was comprised of largely white Protestant males. The addition of females,Catholics, Jews, blacks, and Hispanics has only made it a stronger university. In a world of globalization, students need a wide perspective.

In supporting the boys, prejudice must be avoided for two reasons.

First, it is morally and legally wrong.

Second, it would not be smart to inflame the potential jury pool if the case does go to trial.

So let's be positive, inclusive, and avoid any prejudice or stereotyping.

Let us all make an effort and if we see such posts inform the moderator so that those posts can be removed. It is in our best interest to keep this site clean and honest, and by all means, non-racial. Last week, someone posted the name of the accuser on this site, and the moderator removed that post as soon as it was reported. We all have to keep an open eye here.

The gag order really illustrates something I've noticed going on in this case. Nifong is working with and through a lot of Durham personnel. Or City Manager Baker is working through Nifong.

This case is very unusual. City Manager Baker is up to his gills in this case.

1) Nifong can't ask for a gag order, okay, he can, but the Defense will use the opportunity to score big points in publicly filed motions detailing Nifong's outrageous public statements. The NAACP steps in; this was coordinated in my opinion.

2) Patrick Baker. Okay, most people know that he got the police together and tried to get to the bottom of the statements attributed to DPD about the victim constantly changing her story. It is widely believed Baker also made it known that he was unhappy with those comments or theories and he questioned the police force. The Defense has said they believe this will have the effect of everyone carrying forward the City of Durham's story (falling into line).

The other thing I saw on Baker is that he was involved in this case again in April. He came out unsolicited and defended the Durham Police actions when the DPD a day or so after indictments were signed, approached multiple players and questioned them without their counsel. They attempted to question players without their legal representation - when they knew they were represented. Baker made statements on the record to the press defending this questioning.


3) The Durham City Council or some government body came out and made an offical statement supporting Baker running an in-house investigation to determine if and who in the PD made statements saying the victim was constantly changing her story and was not credible. The council said they felt the need to publicly support Baker.

I think this a two headed (at least) monster in Durham and Baker has been acting very suspiciously. The council feels a need to publicly support him? I'd be willing to bet they were ASKED to pass a public motion supporting Baker.

Why has Baker inserted himself at critical points in the investigation to keep it on track.

Baker and Nifong. Remember Vernon Jordan and Bill Clinton?

Baker actions are not typical of a Police Chief, much less a City Manager. This case seems to be very important to Mr. Baker. Important enough for him to conduct an intra-force investigation before the first court date of the case? Important enough for him to dispatch Police Officers
to the Duke Dorms in a controversial move that was sure to draw fire. Then the City Council introduces a motion to support Baker's actions in the Duke matter? This is a rape.
There has been multiple rapes in Durham since this alleged party rape. I'm sure Baker had no involvement in these other rape cases and I'm sure the same applies to the City Council and the Durham Chapter of the NAACP.

I was not one of those suspicious of Baker initially, but as I look deeper, I think he's involved or trying to hide something.

I think Durham is the worst place in the state for the trial. Think about it yourself for a while and see if you don't agree. Ask yourself "is the jury pool going to be better or worse in other similarly sized or larger cities in the state?"

I think this jurisdiction will have a lot of blacks in the jury pool, a disproportionate number, and some will likely be trying to get on the jury stealth. They'll know to show no flags. Even the Dukies who are in the pool may have their own grudges with the athletes. Imagine the liberals arts department, the profs, the TAs, the grads.

This is strictly a personal opinion, but I'd sure want the case out of this jurisdiction, where you never know the politics. Get it somewhere that Nifong is powerless.

The pressure on blacks to support the "black" side of this in the Durham black community is off the chart. THAT is why Kim Roberts suddenly changed her tune and started singing one more helpful to Crystal. It affects the blacks on such a jury. That is what made the OJ verdict what it was.

I am a Durham city employee. I hear my AA fellow employees talking about this case.

The chief superior court judge is Orlando Hudson who is black.
Hudson has to run for re-election.

In this case, which Race was involved, Hudson was solidly behind the black convicted killer:

Summary:
Desmond Keith Carter went to the home of his 71 year old neighbor, Helen Purdy (who was white), and asked to "borrow" money. When she refused, he stabbed her 13 times and took $15. Carter confessed to the crime, at first claiming that Purdy got excited, attempted to push him and fell on the knife. At trial, Carter admitted the killing, but argued that he was intoxicated on alcohol, crack cocaine and tranquilizers when he stabbed Purdy. The jury did not buy either story. Carter was on Parole at the time of the Killing. Carter suffered a stab wound in the attack. Carter said that four white men had jumped and stabbed him.

Carter's defense lawyers argued to Judge Hudson that Carter's original lawyers weren't good enough and that racial bias against black defendants accused of killing whites made his trial unfair.

Durham Superior Court Judge Orlando Hudson agreed to stay Carter's execution on 12/04/02.

Two days later Judge Hudson was overruled by the North Carolina Supreme Court.

We know many facts. Many have concluded, after 3 months of non stop racial discrimination against the Duke lacrosse team that the heavily black city government, police department and white district attorney Nifong are railroading Dave, Reade and Collin because they are white.

The entire lacrosse team was villified and slandered because they are white.

To point out these extremely obvious truths is not prejudice.

It is simply acknowledgement of the truth.

Perhaps if you were a white who lived or worked in Durham, you would be more aware of who is prejudiced and racist in this town.

I am a Durham Resident and I have posted on this blog before. We tried to organize a group of people to begin a letter writing campaign and organize a support rally for the players on June 19th. Unfortunately people are afraid to speak up in support of the players for fear of being considered a racist. EVERYONE I speak to knows that this is a false accusation and nothing more but when it came down to it people are afraid.

I have friends who grew up in Durham and to sum up what has gone on here over the past 30 years, whites are afraid to speak up because the blacks of Durham are racist and want all whites to pay for things that happened in the PAST.

I am NOT a racist. I have friends who are black. They are embarrassed by the majority of the population and their behavior. They are NEVER held accountable for their actions and everything is somehow the white peoples’ fault. There are many liberals here who champion their cause and think that if you do not support any and all blacks you are racist.
Durham has gotten worse over the past 8 years starting with the corrupt government all the way down to the school board. It is scary and not getting better. 99% of my friends have put their children in private schools even if they cannot afford it. No one wants to send their kids to public school and God help you if you get into even minor trouble in Durham and you are white.

This story is almost like a Stephen King novel. We are all waiting to wake up from the nightmare or for Nifong to come out and say he is being blackmailed or he slept with Crystal. We want it to be something, anything that would explain WHY this has gone on as long as it has.

The sad truth is though that Collin, Reade, and Dave’s lives are forever ruined. The damage is DONE.

No recanting of the accusation, dropped charges, or innocent verdict will change what this whore did to them. It doesn’t matter.

IT is a sad state of affairs in Durham. If only Nifong had been elected court jester.

Now, we have confirmation for it. This is exactly why we have to work together on this. We have to work hand in hand, and try to resolve our respective problems. You need to save/fix your community; we need to save the lives of three young men and save/fix our university. It is not going to be easy, but we have to make the effort. Remember this:

From the report of Officer Shelton who was the first officer to respond to the a/v and 2nd dancer at the Kroger parking lot.

He first spoke with the 2nd dancer and the Kroger security guard about the woman who either could not, or would not get out of the car.

He then walked over to the car and saw the alleged victim.

"She was wearing a see-through red outfit, with no undergarments and one high-heel shoe," Shelton wrote. "She was unconscious."

Shelton says he got an ammonia capsule from his patrol car.

"When I used it, the female began mouth-breathing, which is a sign that she was not really unconscious," he wrote. "My experience is that unconscious people wake up rather quickly when exposed to ammonia capsules.

"I grabbed the female and attempted to pull her from the vehicle. She grabbed the emergency brake with her left hand and would not come out of the car. At this point, I applied a bent wrist come-along [maneuver] to her right-hand arm? once she was out of the car, I released the pressure and she collapsed to the ground."

Shelton says the woman would not speak with police officers, so they decided to take her for involuntary commitment at the Durham Access Center. A short time later, Shelton got a call from another officer that made him go back at talk to the alleged victim again.

"He called me and stated the female stated she had been raped...Once at Duke [Hospital], I spoke to the female, who was now cooperative," Shelton wrote. "She said some of the guys from the party pulled her from the vehicle and groped her. She told me that no one forced her to have sex."

Then, Shelton says the alleged victim's story changed again.

"Within a few minutes, I was told that she told the [doctor] that she had been raped? I returned? and asked her if she had or had not been raped. She told me she did not want to talk to me anymore and then started crying and saying something about them dragging her into the bedroom."

The report also shows inconsistencies with the story from the second dancer. The alleged victim called her "Nikki" that night. According to the report, neither woman told police that Roberts also performed at the lacrosse team's party.

Also, kudos to Kerstin Kimel and the women's LaCrosse team. They almost beat the defending champions. Well, done! Also, thanks for the support they gave to the men's team by wearing the bands.

If we want to help Reade, Colin, and David, then we must be positive, strong, and graceful. There is a great definition of courage: grace under fire (someone famous said that, not me) That is what made Duke great. We need it now more than ever.

AV's story changes to rape when told she was to be involuntarily committed!

"A handwritten narrative report by Sgt. J.C. Shelton that is attached to the motion says the accuser first reported being raped after officers had decided to involuntary commit her."

Officers initially encountered her in a supermarket parking lot and had to use ammonia capsules to rouse her from a parked car, according to court documents.

The woman then reportedly told officers that she was groped by some of the men who pulled her from a car, but was not forced to have sex. According to Shelton, the accuser then told a doctor examining her for evidence of rape that she had been raped."

"At some point in their interviews and investigations, one or more of these officers asked (the accuser) to describe the men who she claims sexually assaulted her, and (she) provided some answer to that question," the motion filed by lawyers Bill Cotter and Wade Smith said. Her "response to that question is critical to the defense of the case and the state may not withhold that evidence from the defendant."

Cotter and Smith represent Collin Finnerty, 19, of Garden City, N.Y., who is charged along with Dave Evans, 23, of Bethesda, Md., and Reade Seligmann, 20, of Essex Fells, N.J., with raping a woman hired to perform as a stripper at a March 13 team party.

District Attorney Mike Nifong gave defense lawyers nearly 1,300 pages of evidence last week, saying it was his complete case file.

Smith and Cotter argue in their motion filed in Durham Superior Court that can't be true. They say that there's only one instance in the evidence they've been given when the accuser is asked to describe her attackers.

The response is contained in what appears to be an investigator's note, they said.

"I asked her questions trying to follow up on a better description of the suspects, she was unable to remember anything further about the suspects," the note from Durham police investigator B.W. Himan says, according to the motion.

The thing I wonder about is just what the DA has got. There must be something other than a statement. Or maybe not. Maybe there is not one shred of evidence and he got what he wanted - reelected - and figures to just ride out the storm in a year or two when the case comes to trial. One of the analysts on Fox speculated that all he could possibly have is another player making an incriminating statement. It's pretty clear there is no physical evidence at all.

Personally I think he might have got taken in a bit by the forensic nurse's report. I would love to learn more about her background because she clearly wrote up a slanted report that jumped to a lot of conclusions and the fact there was no toxicology sample taken is a huge, huge, oversight - and that is putting it kindly.

It is a right to have a jury of one's peers. But can a defendant get a bench trial (judge as trier of act and law)? If so, is it his choice or must DA agree?

Prior post again alludes to talking heads postulating a lacrosse player as a defense witness. If there was such a person with respect to Seligmann, the DA was required to disclose that when he handed over discovery file. Also, such a hypothetical witness would have known Seligmann was not at the party during rape and should have bee able to confirm Evans making it possible to indict him at the same time as Seligmann and Finnerty. It would appear Nifong's silver bullet does not exist.

filed by DAvid Evans Attorney, the SANE nurse was still in training.

So was the Doctor who examined the alleged victim.

Well, well, well, the combination of women's studies degree and SANE
nurse still in training does not sound as if the exam was an objective one.

The nurse found "tenderness" in the breasts. That means perhaps it was about 10 days before her next menstrual cycle. Edema in the vaginal tissues is consistent with recent intercourse. Intercourse with 5 clients, 2 drivers and 1 boyfriend in 2 days might produce edema.

12 out of 17 sections of the rape exam were missing.

DA(TPOS) & DPD just happened to leave out the fact that there were two previous "ID line-up" given to the accuser. where she didn't not ID any of her so called attackers. none of the notes or records of these 2 accounts were turned over to the defense lawyers.

the notes and reports are missing from 2 Durham police officers that were on duty and were also investigating the incident that night.

Nifong (TPOS) stated that he had turned over ALL the evidence in this case to the defense.

So one of the two "drivers" finally speaks. What a great guy, he drops her off and is suppose to pick her back up in a couple of hours.

After a few hours he doesn't hear from her but can't be bothered to check up on her. He doesn't hear from her till 7am the next morning. At this time she tells him to pick up her kids. But he doesn't do it because he doesn't know her that well. Which begs another question of why a woman would send a man to pick up her kids that she doesn't know that well.

The driver is probably lying and knows her better than he's letting on. Remember the cop from the radio transmission tape.

After the first five minutes of Seligman's hearing, I knew Judge Stephens was bad news.

Judge Stephens broadcasted it loud and clear - if you think I'm going to be the one to stop this runaway train - you are looking at the wrong guy!

From what I heard on 770 WABC Radio, Stephens eats lunch with Nifong once a month and Stephens knows where his bread is buttered.

Stephens grandstanded in that hearing and made sure his sound bytes would give him the biggest bang for his buck.
To his Durham audience, Stephens proclaims this case is not going ahead of any case; these defendants will be treated just like anyone else.

Stephens can play and act like this players are getting treated like everyone else, but I seriously doubt other defendants have the City Manager interviewing beat cops and characterizing their statements in a public report.

Other defendants don't have posters made of them (even players that didn't attend the party) and disseminated at 3 University Protests directed at them. Name another defendant that paid for his own Lie Detector test and had to contend with a DA doing 70 National interviews insisting the evidence against them was irrefutable, yet no charges were pending.

Judge Stephens bad act is transparent to everyone that has ever seen a bad politician.

These defense attorneys are pretty sharp, and this may come up in Seligman's motion to recuse Nifong, as in :Judge, he not only dissembles and decives the public, he has engaged in a scheme or artifice to defraud the court," and then laundry list his prevarications.

And most galling of all, dingbat Brodhead and Duke University crawled into bed with Nifong and his crew, abandoning 46 of their own students. But then, Duke is nothing more than a marxist hate whites racist propaganda machine after 40 years of feminazi and minority studies programs.

One thing I am certain of: there will be more facts coming out that will show even more decisively that this whole thing was a "crock."

I was reading the case of a family that claimed their daughter was molested at a Synagogue by a construction worker at the synagogue. The report I read said that the family used the laws to shield the child's identity and prevent the Defense lawyers from finding out other similar claims they had made. To make a long story short the family acutally OWNS the synagogue after the settlement.
Only after settlement, it was discovered that the family had made other similar claims and lawsuits.

The more we know about this case, the more we know about the active misconduct of Nifong and others who work for the city of Durham.

It is not just Nifong, it is everyone, Mayor, Council members, City manager, even the school board.
When you add it all up, the sum is a conspiracy that probably needs FBI investigation and Justice Dept prosecution.

But it will never happen, since the motto of the Justice Department is "civil rights for all but whites."

Neither Nifong nor anyone else in the Durham power structure will be held accountable by the state bar or anyone in state or local government due to the "demographics." of North Carolina.

This sort of thing could happen to any white person living in North Carolina or any area with similiar "demographics."

And how many people have the kind of money that the Finnertys. Seligmanns and Evanses have. Who could come up with $400,000 in full, not the usual 10% bail?

Speaking of bail, remember the same week Seligmann and Finnerty were required to post $400,000 in full a black man charged with murder was allowed to post $5,00, 10% of $50,000 bail.

The judge is very concerned about the cell phone. He mentioned that it might be owned by someone else and that would raise third party AND FOURTH PARTY concerns. I remember about 20 years ago, a man named Roger Boas ran for Mayor of San Francisco. A 15 year old prostitute saw the posters up around town and recognized him as a steady customer of her teenage
squad of prostitutes.

The newspapers found out about it and of course his political career was finished.

Of course I'm not saying that the a/v has any connection to any public officials in Durham.

And NC has nothing, no one, certainly Durham has nothing, of any power able to remove the offending one from office. Durham (Democrats only-no Republicans ran) had a chance to vote Nifong out but what did Durham do? They kept this criminal in power because he did their bidding. And that's that.

Don't wonder why Nifong won the primary. He did exactly what his constituents wanted him to do, go on a vicious racist whitch hunt against whites, any whites he could grab in his trolling net.

I take no position on the Duke rape allegations, and I am an alumnus of Duke. I await the judgment of the judicial system. I flatter myself to be on the side of truth and justice and humbly hope that it is more than flattery.
However, I do note the appalling dichotomy between the (1) the gravity given the Duke allegations by the Left, notably the "Mainstream Newsmedia" (i.e. its Political Machine), and (2) the dismissal and trivializing of the claims of Juanita Broaddrick by the same Left, notably the "Mainstream Newsmedia" (i.e. its Political Machine).

This appalling dichotomy is nothing unusual. It is part of the general hypocrisy, ruthlessness (sometimes subtle, sometimes not), illogic, inconsistency, mendacity, and essential malevolence of the Left.

The fact also cannot be ignored that this dichotomy is an example of how the Left will say or do anything to advance its agenda. It's agenda, of course, stripped to the fundamental, is power for its own sake, nothing more.

Vice President for Student Affairs sends e-mail alerting Duke students to a rumor reported by the Durham Police to students living off-campus of a planned "drive-by shooting" of a house near Duke's East Campus, emphasizing there was no reliable information to support the rumor.

And lastly, more on the Durham Committee on the Affairs of Black People.

The population is roughly half black and half white; the majority of city council members are black. The Committee's endorsement did help other candidates win their races -- Rep. David Price and Sheriff Worth Hill -- or get into runoffs -- Larry Hall and Anita Smith in House District 29. But in two districts drawn on racial lines to ensure that the Committee would have control of those seats, their candidates were soundly defeated. A third member of the Committee slate -- Steve Matherly -- came in at an unsurprisingly distant third in his race for District 3.

For years, Committee leaders had been promising to defeat Wagstaff, but they could not keep her and George-Bowden from packing their endorsement meeting with supporters. Perhaps the incumbents couldn't make the endorsements stick, because Committee leaders didn't stick with the endorsements.

This scenario is even more unusual when you consider that the historically democratic Committee has for a number of years tightened up eligibility requirements to prevent candidates from packing meetings with supporters.

Regardless, in District 1, Omega Curtis Parker edged past the 40 percent mark and avoided a runoff.

Dolores Davis Paylor also outpolled Wagstaff, 33 percent to 25 percent.

Interestingly, the Republican Party endorsed Parker, a Democrat, who won by only a few more votes than there were Republicans voting in that district. Add in the stealth Republicans who've switched to unaffiliated over the years so they can vote in Democratic primaries and it's within the realm of possibility that Parker's Republican endorsement gave her a winning edge.

Okey-doke. Now, who are the powerbrokers behind Nifong. The "Committee" at its website said they were endorsing Keith Bishop, who lost, to Nifong. But apparently, the Committee's "Sheriff" got the win.

"District 2, the Rev. Fred Davis energized supporters who possibly canvassed every house in the district. Davis defeated George-Bowden by a landslide, 53 percent to 33 percent. D.J. Waldow came in at less than 13 percent, even with an endorsement from the Friends of Durham, a moderately conservative white group.Hmm.. who are the Friends of Durham?

Here's who the Committee endorsed.

And in re Nifong's win? "After the election results came in, yellow-shirted Nifong supporters chanted his name as they planned what they called a Cinco-de-Miko party in honor of his victory"

Apparently there is a group called The Durham People's Alliance who works in tandem with Lavonia's "Committee".

Both the Durham People's Alliance and Friends of Durham have recently released their election endorsements.

Following are both groups' explanations of some key endorsements:

Both endorsed incumbent Mike Nifong for District Attorney. Nifong has a longstanding rapport with the People's Alliance and, "Our general feeling was that he is a person of high integrity and great skill," said Tom Miller. "He's a tough but fair and honest prosecutor. When you have the state power concentrated in one person, you want that person to be thoughtful and sober."

Smith cited Nifong's experience as a prosecutor and his managerial skills as reasons for the endorsement.

The NAACP has had enough of the truth coming out. They are now having their attorneys demand a GAG order from the Judge in this case. Can't have any more facts come out that might shape public opinion, now can we?

Even these power pushers have seen the total and blatant fake that this woman is. But now they can't come down against her - a sister - can they - after their constituents just re-elected Nifong? So, what to do. Demand an end to the TRUTH TELLING that has been done by the defense attorneys so no more image of their darling being messed up by the truth.

The entire thing sounds like the Tawana Brawley case. Only now instead of Sharpton doing the political posturing you have an over zealous DA, up for reelection making a political stance at the expense of two lives. Unless he's got something on the kids that is not being revealed, it doesn't look like there is much of a case.

Even throwing away Duke's chances at a national Lacrosse Title, without due process was a knee jerk reaction (it would have been interesting watching crowd reaction and antics).

The Brawley case hits home since it occurred in where i grew up. Dutchess County is still a very tight-knight community, lots of big extended families with huge networks of friends their relatives that all know each other. I've mentioned a few times how dad was friends with people as diverse as G. Gordon Liddy, William Kuenstler and Pete Seeger, while my brother was friends with Keith Idema, the local gun-nut

One of my sister's friends was Harry Crist, who killed himself after being listed as a prime suspect in the Brawley Case

Nifong's case in chief is already in shambles, and Crystal's story hinges entirely on the SANE report. My guess is that he will simply authenticate the report with little or no further questions. At this point, he might as well throw the SANE nurse under the bus because every conceivable witness (from Crystal to every police officer to the Durham Access Center to the Duke police and on and on) has to be discredited in whole or in part. This prosecution is a sick joke.

His case in chief will last about an hour, consisting of the SANE report, Crystal's newest version of events and in-court ID, the infamous DNA on the fake fingernail, and that's about it.

Probably exactly what he told the grand jury. I still think there is a fair chance this will never get to trial because eventually a real court will get hold of this.

Maybe the reason it took longer to identify David Evans is because her helpers had to research him to make sure they didn't strike out with another player who wasn't even there during the supposed main event. They found a target who had all the credentials: (a) wealthy family and (b) was there that night and (c) was automatically suspicious because he rented the house.

It was a given that his DNA was going to be on SOMETHING that could be tested, and maybe someone was smart enough to figure that out.

I think Nifong is hoping to be recused from this case ... maybe that explains all of this insanity. If he does not lead the case (it will be taken by a less experienced associate .... though Nifong has NO experience himself with sexual assault trials) ... if he is taken off the case then one of his associate DAs takes the case. When things blow up (as they certainly will) Nifong is still "safe" as he can say that he was not able to prosecute it as he would have liked. I have never paid attention to District Attorney elections in the past .... but I will study them like the night before finals from now on.

Funny, that "3" became and important number....the same number she used years ago in another "rape" claim. And then there's the "3"-boyfriend and two drivers??

Wonder how many times she has "feigned" rape for her clients. A favorite male fantasy, yes? She must have this trauma down pat by now.

How about this for a possibility. The team photo that has been circulating has the players in alphabetical order and Evans photo is right next to Finnerty's. Maybe she got a hold of the team photo and remember the one next to Finnerty. Of course there are other scenarios like picking the richest players. You can never count out a coughing cop scenario.

Then there is the are you sure he isn't the one scenario. Maybe AV was just getting tired of looking at pictures and just picked one. Or maybe AV just threw darts at a dart board with the team photo and Evans was the one AV hit.

Maybe whoever 'helped' AV decide which player to finger next even knew about him handling the fingernails, or possibly not. They needed to find some DNA on something from her, didn't they, and somebody would certainly be smart enough to know that he or his roommate were the best shots because they lived there. I doubt if she can even spell DNA, that decision process belongs to someone else, quite possibly even Nifong (by having someone 'steer' her that way.).

One thing is for certain - I think the choice of David Evans was too convenient to be circumstance. I think he got targeted for several reasons, none of which have anything to do with him (or the others) laying a finger on her that night.

People administering IDs can convey things even unintentionally. We all learned how to read non-verbal language before we read or spoke sentences.

With this bunch it's easy to believe it was overt and intentional, but it didn't have to be.

I think the Investigators, the same guy administering the photo lineup, thought the bunch of them was lying. There was a wall of silence. Even though they had been threatened and rattled - the 18 and 19 years olds held firm in the face of adversity. I think the investigators (they ALWAYS have a theory) most likely thought the 23 old uniamiously voted as Team Captain - David Evans - was one of the only guys the could keep them all in line. So, either they thought he was holding them together or they may have thought if Evans was facing charges and pressure was brought to bear on him, he may back off on the flock or cave and bring the whole thing down like a house of cards.

It's only a theory, but I do know how the media works. Most of these media people run with theories given to them off-the-record or hinted at during a supposed hypothetical conversation. I don't think it was a coincidence that Geraldo was on National TV with O'Reilly saying that the week of the indictments he expected the soft white boys to run to the DA to get plea deals to avoid 20 year sentences.

I think someone on the Prosecution side of house was floating those theories and it also explains why the media was also so sure the team was guilty. Ostensibly they were not going to run and plead to crimes they didn't commit.

How many times has a Doctor or Nurse asked you questions during or after a test and you KNEW from the question or their reaction there was a problem with the test?
If the prosecution thought this was the guy, they could've easily telegraphed it before the offical lineup process. If I keep asking you questions about one guy and keep showing you his picture. It doesn't take long to pick up on the fact that you have suspicions about that guy.

His office is pre-occupied with this case. Nifong has made the highly unusual announcement that he himself will even try this case.

I'd write the list of serious crimes that have occured in Durham over the last 45 days, but I do not want to get Carpal Tunnel Syndrome.

I know kids have been shot, a man was shot point blank in the face. A man was found murdered in a Car dealer's lot. There's been home invasions. Multiple Rapes.

Children have been poisoned (Lead-poisoning) by Durham City Water - and the City Manager is running around playing Public advocate and spokesperson for Mike Nifong as it relates to this case.

Even the manpower that is being used to "protect" the AV is ridiculous in a place with serious crime problems like Durham.

This is why Distric Attorneys have a responsiblity to only bring cases that they can prove beyond a reasonable doubt, due to the practical realities of our justice system.

But of course when the entire elected and affirmative action civil service city government is motivated mostly by hatred of whites why is it surprising that they ignore the contaminated city water?

Any one of us could be the next victim of the DA - I just wonder what the recourse could be on this. Can the DA be effectively sued?

It's my understanding that everything, at this point, discovery wise, must be in the hands of the defense team and they would be hard pressed to be out there lying about what is or is not there. I just don't get it.

Also, the black/white part is really disburbing if that has anything to do with the DA moving forward. I'd say that that would be racism - with the DA the racist.

Well what may be happening in Durham could be as simple as a prime example of the "Peter Principle."

1. Nifong has clearly been promoted over his ability. Who knows maybe he was a ok when he had boss he was directly answerable to.

2. Nifong stirred up much African-American passion in the community. The adults who can right this situation both have to run for reelectin and don't want to spark a riot in their community.

So we observe the Judge not hear the bond reduction. The judge doing much preening about treating this case just like any other. This of course could, as many here worry, be evidence that Durham is corupt to the core. But it could be that the Judge is one of the adults and knows this case will end in a way that could cause bad things like riots to happen in Durham. If you were the judge, wouldn't you want to stress over and over you were treating this case like any other?

To me the one behavior I worry about the judge is that he did not admonish Nifong for his smirking in court when the defense council was talking.

Friday's defense motion also said there was no report about the earlier photo lineups included in the documents Nifong gave defense lawyers. But the April 4 session in which she identified the three suspects was videotaped, and both the video and a written transcript of the session were included in the material given to the defense teams.

The motion uses the apparent discrepancy in record-keeping as one example to suggest the defense hasn't yet been given all police records related to the case, even though Nifong said in a court filing May 18 that the state's "entire file" had been handed over.

"Multiple law enforcement officers who participated in investigative activities in this case did not record their activities as required by law, or they did not turn those records over to the Durham County District Attorney's Office as required by law, or the District Attorney's Office did not turn them over to the Defendant as required by law," the motion argues. It goes on to ask a judge to issue a series of orders ensuring that all records of the investigation are given to the defense.

Included with the motion, the handwritten report by Shelton, the Durham police sergeant, provides far greater detail than anything previously in the public record about the accuser's demeanor and statements on the night in question. Shelton was the first officer to arrive at the house where the lacrosse party took place at 610 N. Buchanan Blvd. the night of March 13.

Police went to the home after an unidentified woman told a 911 operator that she was driving by when men began calling her racial slurs.

In fact, the woman, Kim Roberts, was an exotic dancer hired to perform with the accuser at the party. Roberts has since acknowledged contacting a New York publicity firm trying to capitalize on her involvement in the case.

According to Shelton's narrative:

-- Shelton left 610 N. Buchanan after finding no one home. A neighbor told him a "rowdy" party had recently broken up.

-- A few minutes later, police were called to the Kroger on Hillsborough Road because a woman wouldn't get out of another woman's car. Again, Shelton was nearby and was first on the scene.

-- The owner of the car told Shelton that she had been driving down Buchanan Boulevard and saw the other woman -- now in her passenger seat -- walking along the street and that a group of white men at 610 N. Buchanan Blvd. were yelling racial slurs at her, so she offered her a ride to safety. (In fact, though, the car owner was Roberts, the second dancer.)

-- The woman in the passenger seat was "wearing a see-through red outfit, with no undergarments and one white high-heel shoe." She appeared unconscious, so Shelton got an ammonia capsule from his car. In response to the capsule, the woman began "mouth breathing, which is a sign that she was not really unconscious," Shelton wrote.

-- Shelton said he tried to pull the woman from the car, but that she grabbed the emergency brake handle to keep from being pulled out. He finally got her out and she collapsed on the ground.

-- Because the woman wouldn't tell officers her name or where she lived, they decided to take her to the Durham Access Center, a mental health and substance abuse facility. There, the woman said she had been raped at 610 N. Buchanan. So Shelton directed that she be transferred to Duke University Hospital's emergency room.

-- At Duke, the accuser told Shelton she was a stripper and had been hired to dance at 610 N. Buchanan Blvd. After their show, she said, she and the other dancer got in a car to leave, but that some of the men wanted them to go back inside. "She said at the point some of the guys from the party pulled her from the vehicle and groped her. She told me that no one forced her to have sex," Shelton wrote.

-- Shelton went outside to call his watch commander to tell him the woman had recanted her rape allegation. But then someone told him the woman told a doctor that she had been raped. Shelton called the watch commander back to tell him "she had changed her story back to being raped."

-- Shelton went back inside and asked the woman "if she had or had not been raped. She told me she did not want to talk to me anymore and then started crying and saying something about them dragging her into the bathroom."

Shelton says he left the hospital after the watch commander told him the Police Department's Criminal Investigations Division had been notified.

About 36 hours later, the woman told investigators she had been raped, sodomized, beaten and strangled by three men in the bathroom at the lacrosse party house, according to police affidavits.

The defense motion filed Friday says that, "incredibly," the information provided by Nifong contains no record about the woman's time at Durham Access Center. Nor does it contain reports by two other police officers who were involved in the situation that night, the motion complains.

In addition, Nifong provided documentation pertaining to only five of 17 sections of a Sexual Assault Exam Report, the motion adds, indicating that the exam was performed by an in-training forensic nurse.

Not only was she completely trashed and changed her story multiple times, there is no way possible that the attending physician would have failed to spot physical signs on her body if any of these events had really happened.

I've been saying since the beginning that this entire thing was a hoax and I still stick to that. It's not only an election-year race card ploy, it's a witch hunt against three young men with no proof whatsoever they attacked her.

I thought North Carolina, as a state, was tough on crime. I remember reading an article a while back saying just that and it said they have thrown people in Jail for not showing up for Jury Duty - in an adjacent county.

The 3 weekends for the AV,with the car theft and trying to run over a police officer that's gotta be something related to an informer.

I don't see how a judge looks the Police officer in the eye after he testifies in court that she tried to run him over - and the COP has been always been consistent on that.

I don't even want to go to the situation where a white person ever told people on national tv to go kill a black person - first it would never be broadcast and second they would be arrested and convicted of a hate crime !!!

I truly hate to chill everyone to the bone but here it is - the reason nfong hasn't dropped the case is that he knows that he can get a jury of sympathetic durhamites to convict these boys without any evidence- a reverse oj. And this would not be just a jury of blacks. No white person in durham would acquit these boys havign to do so publically withtheir name eventually being released to local papers or by other jurors. They have to continue living in durham. If they own a gas station, they would never get any customers again. Look a the pressure jury of scott peterson was put under - and that was in a far more cosmipolitan town in ca. BTW I'm not sayign anything pro or con about that case except for the fact that certain jurors readily admitted that they were under enormous pressure to convict peterson-- look at the jury foreman who wanted ot acquit but who had to leave the jury because of pressure from the other jurors and this was an educated engineer- can you imagine the pressure of any juror trying to acquit one of these boys in durham ?

Alas the only hope is change of venue and that is whay nfong will fight this with everything (and others in durham will fight such a motion as well. It is a very scary place........

This is what the Duke flacks are so worried about. If this case continues through next year, Duke will likely face two choices

1. Become for the near-term a local-regional rather than national school
2. Move the undergrad campus.

We may be seeing the first recent example of a malicious prosecution changing a city and a college.

It is easy to see 10 years from now a Durham that is blacker, poorer and more corrupt and a Duke that has hunkered down behind its high walls and is doing its best to hide.

Maybe the reason it took longer to identify David Evans is because her helpers had to research him to make sure they didn't strike out with another player who wasn't even there during the supposed main event.

When the Investigators were dispatched to the dorms to question the players without their Legal Counsel (highly unusual), mind you the day AFTER the first 2 indictments were signed, the investigators wanted them to answer questions about WHICH players were at the party.

What are the odds the fourth guy she IDed in the 3rd (final) lineup was not at the party.

I don't know if Nifong in his enclave of Durham sees the case realisticly. He is in a jurisdiction where the jury pool, the affirmative action police force and appointed and elected officials are either black or totally dependent on black voters to stay in office.

Durham has had 3 University protests against these boys and the electorate in the City is absolutely hostile towards the LAX players. I saw Nifong laughing in Court when Seligman's attorney mentioned his alibi. I've heard reports that Nifong speaking off the record is still very confident, just very upset.

And then, if the Change of Venue is not granted, Nifong has a real chance. If the trial is held in Durham, the players will be found guilty and given the maximum sentence. The jury will be mostly black. Like the OJ jury, the jury will be in constant contact with
the black activists. Any juror thinking of aquittal will be threatened and pressured like the OJ jurors were.

I think back to the Totally Unbelievable comment Nifong made
when asked about a report of the AV saying it was 20 men first and then 3. He said he wasn't aware of that, and he said if a statement like that was made, he didn't think it would be relevant. 20 men or 3 men - not relevant.

Maybe he had high hopes for this case and the National position in the Media or Politics following it. Dreams die Hard.

Get ready for the new refrain from the talking heads: Let's let Justice work, let's wait and see.

I've heard this more and more on the radio driving thru some big cities. The liberal MSM doesn't want to hear any more now, it led the News every night when it was information incriminating to the players, now when it's information setting the record straight or making people look at this case differently - the refrains are STOP!

Suddenly, discussing the case somehow prohibits a thorough hearing of the evidence in court. Suddenly, who are we to discuss such things - we are Lawyers nor Judges: we have no business hearing all this evidence.

It was predictable, I'm hearing it on the radio, I've heard it on TV. The Newspapers are selecting letters echoing this
sentiment for print. The NACCP is having Press conferences announcing court filings asking for a GAG order.

Think about that - a press conferenece to ask for a Gag order!

PC is the rule at Duke apparently because their spokesperson is quoted as praising the projected increase in diversity.

Duke is so proud that next year a full 40% of the Freshman class will be minorities. No word about how many white males with SAT scores of 1575 were turned down to make room for minority females with SAT scores of 900.

I forgot, the fourtheenth amendment, according to both Frances Berry of the US. Civil rights commission, and the Department of Justice does not apply to whites.

I have grown to despise that word....40% of the students will be of minority status. (11% more and they will be the MAJORITY....and then what will they beef about?)

The tenor of recent posts has got me down. Please, people, don't write off Durham...though the place is schizophrenic at times it's not a total hell hole devoid of people with ethics and morals. Remember, many people here followed Nifong's lead only because he abused his position as an elected official supposedly acting in the name of justice and came out so convincingly saying a rape had occurred.

Now that the truth is coming out people who initially thought something was up (myself included, sucker that I was) are talking to friends and spreading the truth. They're on this website and they're looking for ways to help. So don't paint us all with the same brush. And by the way, this is not a Democrat thing. I voted against the b*stard in the primary (as did all my friends) and we fell short. But that doesn't mean we're going to slink into dark corners because we're afraid of being labelled racists. Far from it. I'm not revealing my identity because if this comes to trial, I want to be on that jury. Man. That would be the best thing I ever did in my life, and I've done some amazing, wonderful things.

And another thing, for those convinced that there is a black majority in Durham, remember it's only 44 percent--not a majority last time I checked. Does anyone have access to the race breakdown of registered voters in Durham (which is how jury duty is assigned?) Given that nationwide blacks statistically register to vote less than whites or other minorities, I suspect that the jury would in all probability be a white majority (if the same holds for Durham.) Finally, the blacks who I am friends with are more able to identify with the parents of the players than with the parents of a prostitute (and they're appalled by the excuse that she would do such a thing just to put food on the table. Come on, didn't she hear The Gap is hiring?)I feel comfortable in saying they're not buying her story.

I wonder when we whites will be considered the minority at colleges such as duke - with the influx of illegal immigrants who will be given instate tuition fees and the rest of minorities given free tuiton by presidents such as broadhead and with the college tuitions rising incremently to pay for these free tuitions soon whites won't be able to afford tuiiton for their children (if they have more than one child) I will be paying 100,00o a year so minority children or illegals can go for 1000 a year? and then you get situations like these articles in the philly news where its ok to hate whites or younf women who defend white guys accused of acrime without any evidence - i am starting to confront something i never wanted to - that depite an utter lack of evidence there were always be liberal "journalists" to jump on the white bashing athlete young man bandwagon -can you only imagine if this was a black accused of raping a white? --stephen smith would be villifying the girl ! the us civil rights commision woudl be down nfongs throat and youd have ever news soutlet and govt organizationa dn ever defense atty down in durham -- I wonder what steven smith wrote abotu kobe bryant? and yea, where are all the great civil rights or leadign defense lawyers like the mark geragos etc... ? who never met a crimnal trial he wouldn';t comment on.... yet silently absent in this case?

Here is what Nifong did not turn over. The dfense has filed motions for:
1. Trancripts of the first two ID lineups (on March 16 and March 21, if I'm not mistaken).
2. Complete notes from the initial police interviews.
3. Evidence from the cell phone seized in March.
4. The missing portions of the SANE exam.
5. Notes (if any) from the detox center prior to going to Duke Medical Center.

I am a white male Durham resident and first time poster. I have been keeping up with the posts on this site and I wanted to make a few clarifications about how people perceive Durham. Just to be clear, I think Nifong is out of control and I do not support his actions.

In response to the poster who stated “No one wants to send their kids to public school and God help you if you get into even minor trouble in Durham and you are white.” This is just flat out not true. I have lived in Durham my entire life and went to high school at Jordan High School. This is a great public school and was just recently ranked in the top 100 schools in the nation. While growing up in Durham, I can say that I ran into my fare share of trouble. I was able to get through this unscathed with programs offered through the courts. In my experience, Durham is actually much more lenient than many of the surrounding counties.

Many posters have also unfairly attempted to lump Judge Stephens into the corruption that occurs with many of the black leaders in Durham. I do admit that Durham has many problems with its leadership due to the intense racism that exists in the community, but Judge Stephens is not a part of this. I know his entire family very well, and he seems to be the only one who is attempting to prevent this case from becoming a circus. The only thing that he wants is for justice to be served, and I strongly believe that he will make sure that this occurs. Keep faith in him.

My last point is to the posters who think that the trial needs to be moved away from Durham in order for the LAX players to have a chance of being cleared of these horrific charges. This theory has been proven to be untrue in previous cases that have occurred in Durham. About 8 to 10 years ago, there was a case against Michael Seagroves (a white male), of Durham, who shot and killed two black teenagers that had attempted to rob his house one afternoon. Seagroves happened to be home from work that day because his young child was sick, and the robbers fled from the house upon realizing that he was there. While fleeing down the road, the black teens were shot and killed by Seagroves. He was charged with manslaughter because the teens were running away and not posing any direct threat to him. This case blew up into a race war just as this LAX case has; with most blacks wanting his head and most whites thinking that he should be let off. The day of the verdict, there was extra police presence in the schools and on the streets due to the threat of race riots. There ended up being a hung jury, and the DA declined to bring the case to trial again because of the intense racial tension that it created in the community. My point of this story is for the LAX supporters to keep faith in the people of Durham. It is true that there are many people in Durham that would vote to convict these people based solely upon their race, but there are many more highly educated people that will vote based upon the facts of the case. I could not be any more certain that a Durham jury would never convict these kids based upon the facts know today.

Here is a copy of a Durham news story about another Rape. The local police department did locate and arrest the suspect... He was jailed under a $150,000.00 bond pending a court appearance Tuesday... This suspect has been charged with rape along with resisting arrest...

Note his bail is substantially lower than the bail for the three Duke Defendants, even though he has a criminal record and resisted arrest.

A Durham man was charged Saturday with a rape that was alleged to have occurred on May 13, according to warrants.

Carl Vincent Johnson, 38, of 8418 Whippoorwill St., was charged with first-degree rape and resisting arrest Saturday, according to warrants.

Warrants alleged that he attempted to run away as officers were placing him in custody.

Johnson was jailed under a $150,000 secured bond pending a court appearance Tuesday.

The accused in the case is black and has a criminal record.

Durham is not the wonderful town they would like people to believe it is. They seem almost embarrassed by having such a prestigious school (Duke) in an area where there are so many poor minorities.

This latest case - a black man, using a gun, rapes a woman and his bail is 1/3 of what it was for the Duke students. This guy has a criminal history that shows he's an habitual offender and certainly not someone you would want in your neighborhood, but the powers that be just shrug their shoulders knowing that there is nothing they can or want to do about making their streets safer.

Any potbangers out there for the woman who was raped by a black man at gunpoint? Of course not - just another hazard of living in the wrong part of Durham.

I do not share your faith in Judge Stephens. He was Nifong's predecessor as DA when Nifong worked as Assistant DA. No doubt they get along great. (I heard they have lunch once a month.) Judge Stephens refused to order Nifong to turn over the cellphone and its contents because that is "something that is supposed to happen voluntarily." He questioned Osborn's request to record everything, although he then granted it. Stephens did NOT admonish Nifong for laughing when Osborn mentioned Seligmann's alibi. (My heart broke for Reade, sitting there and hearing the DA laughing. How could anyone have faith in that judicial system?)
I am sure many Durhamites voted for Nifong because he was "experienced, professional and competent." I am sure those same people had no idea that "absolute power corrupts absolutely." Judge Stephens will no doubt follow in Lance Ito's footsteps. I expect he will totally have Nifong's back in all of this. (Of course, Stephens will spin it that he can't do anything that will create a problem for the trial judge!)

I am the parent of a Duke student not affiliated with the LAX team.

In talking to her and visiting campus, I find that she and her friends believe the boys are innocent.

However, they are somewhat apathetic about the situation for two reasons. First, they expect the 3 boys to be eventually exonerated. Second, they are aware of the LAX team's reputation for rowdy behavior (although this in no way justifies the current witch hunt).

These apathetic students do not realize that legal fees are costing hundreds of thousands, and that the boys are facing lengthy prison time if a miscarriage of justice occurs (which does happen).

If this situation continues through the summer, supporters of the LAX team need to do some serious organizing among returning Duke students, incoming freshmen, and parents of Duke students-- as well as continuing contacts with the news media, Duke alumni and contributors, and sympathetic residents of Durham.

This was obviously written by somebody whose only impression of Durham is from biased media following this case. The fact is that Duke IS Durham. Duke is, by far, the largest employer in the Durham community. Duke also contributes to many charities in the community as well as donating money and computers to the public schools. Without Duke, Durham would be just another poor town in North Carolina. Instead, it is a thriving hot spot for technology and innovation and has attracted many other businesses to the area (Research Triangle Park).

The Duke community and Durham have never got along that well. A lot of that is the type of students Duke tends to attract. Duke has a reputation in the state for bringing in some real spoiled brats who have massive sense of entitlement. Most of the kids aren't like that but some are and their attitudes are a big part of the reason you see so much town-gown tension.

It only takes one house of obnoxious students a year to poison how a neighborhood feels about a school and with the number of Duke students who live in the neighborhoods you are bound to have incidents.

"Nifong saw this case as a golden opportunity to ensure re-election and went full bore into it before getting all the facts. Because he'd run his big mouth so much in the opening few days he couldn't back down without hurting himself badly politically in the black community. So he'll continue to pursue this no matter how shaky his evidence is.

Durham has a history of black radical politics. The school board for instance has often had some real out of control people on it.

In all fairness, the jury should still be out on Judge Stephens. H e had a no nonsense demeanor at the first hearing. He told the opposing sides to submit an order on the cell phone or he would write his own. By now the defense probably has analyzed it. He did not refuse to lower Reade's bail, he told his lawyer to file a motion on that, which is proper and finally he said he would not move thisa case ahead of others which is only fair. If Nifong is a friend, he is probably asking him what the heck he was thinking and trying to help him find a way to end this.

Very informative, yet scary article by Anderson on the LewRockwell site. I happened to live in North Carolina during the day care cases and they were absolutely absurd, yet the owners were convicted. The judicial process in NC is corrupt and I very much fear these young men could face the same fate. I pray I am incorrect and that a jury will see through these lies.

How many real victims aren't getting the searches, investigations, and prosecution they deserve because this FRAUD of a case is Durham's Priority number 1?

There are people getting hurt other than the lacrosse players and their families. There's only so much court time, preparation, investigation, and lab time to go around.

This case has even kept the City Manager busy. A least one kid in Durham Died of Lead Poisioning from Durham's Tap water, but Patrick Baker is running around reinterviewing Police that have already filed reports and know how to do their jobs.

The accuser is a black woman, and there's nothing the media loves more than a black victim, especially a woman. conversely, the media abhors black criminals. They almost completely refuse to publish photos of black criminals.

They also refuse to ever mention race if the criminal is black or hispanic, but if the criminal is white it is in the headline.

Readers of the liberal media know that if the race of a criminal is not mentioned he most probably black.

I just heard some people interviewed in Durham on this case on the Radio.

Looks like they are focusing on the CIVIL case. Victoria Petersen was on the Radio and she said she's talked to lawyers in Durham and she's talked to the AV Family.

She said that the one of the people on the lease of the house was EVANS, she intimated that Evan's parents name was on the lease. She said that a 22 year old old invited the strippers and served alcohol to underage men in this same house.

Mrs. Petersen said that the Evan's Mother - a lobbyist in Washington is going to be held financially responsible for the events that happened in that house that night. She mentioned the lower standard in the Civil court and she said the Washington Lawyer Father (that she connected to George Bush's White House) will have to pay for the actions of his son.

Again, she claimed to have spoken with many lawyers and were assured that the AV has a super strong case in civil court. Then she mentioned Duke's liability. She said Duke owned the house and had protected the unlawful players and looked the other way for years, allowing this to happen.
She said Duke would be a defendant in the Civil lawsuit also.

So, you can see where this case is going. The AV, and the black lawyers in her entourage are looking to get super Rich from this case. The Race angle will be used to exploit the jury and move the damages into the ionosphere.

Noticeably absent was the discussion of the CRIMINAL case: by the Durham women speaking.

Scary but this was kind of expected. Does this not show what the real motivation of AV is? How would this civil suit affect the criminal one? Can't the families involved protect their money (if they have any left after the lawyer expenses) before the law suit? There has got to be something they can do.
